Terms & Conditions

The terms and conditions of sale apply to all bookings made on the internet, via the website www.rosemarymarrakech.com. They are governed by Moroccan law without prejudice to any protective imperative provisions that may be applicable in the country of residence of consumers. 

The client, prior to ordering the services, declares that the reservation of these services is made for his personal needs and declares that he has full legal capacity to commit himself under these general conditions. The following information is mentioned at different stages of the booking process: prices, payment methods, general terms of sale and accepted means of payment.

Reservations

The customer acknowledges having read the terms and conditions of booking the available services on the www.rosemarymarrakech.com website and has requested and obtained the necessary information to make a reservation with full knowledge of the facts. He remains solely responsible for his choices in terms of services and their suitability for his needs, and no liability of the hotel can be sought in this regard. The booking is deemed accepted by the customer at the end of the reservation process.

Bookings made by the customer are made through our cloud-based booking system (Provided by Hotel Runner) and accessible online via the website www.rosemarymarrakech.com. Upon receipt of the booking confirmation, or during online prepayment by credit card, the booking is deemed. The customer certifies the veracity and accuracy of the information transmitted.

The Website acknowledges receipt of the customer’s reservation by sending an e-mail to the customer without delay to the e-mail address that he has previously entered. In the case of online booking, the acknowledgment of receipt of the reservation by e-mail summarizes the offer of stay, the reserved services, the prices, the conditions of sale relating to the selected tariff, accepted by the customer, the date reservation, the after-sales service information, as well as the address of the seller’s establishment where the customer can make claims.

The cancellation / modification of the reservation can be done directly on the Site or directly with the hotel. In case of interruption of the stay due to the customer, the full price agreed upon will be cashed. In the case of reservations with prepayment, no refund will be granted as a result

Check-in / check-out

The Check in is starting from 2.00 pm the day of the reservation.

For the check-out, the customer is informed that he must leave the room by 11.00 am on the day of the end of the reservation. Otherwise, he will be charged an additional night. All bookings are nominative and therefore personal. It can not under any circumstances be transferred to a third party, whether for free or for a fee or for commercial purposes.

When the customer arrives, he may be asked to fill out a police card with a piece of identification to verify his identity.

In the event of an exceptional event or the impossibility of making the reserved room available to the client or in case of force majeure, the hotel reserves the right to have the guest stay in a hotel of equivalent category, for services of the same nature and subject to the prior consent of the Customer.

Credit Card Pre-Authorization Policy

A pre-authorization amount of 2500 MAD is temporary hold on the credit card provided by the guest at the check-in, and will be released at the check-out. The pre-authorization is not a charge and no funds will be debited.

The pre-authorization guarantees that the funds are available in the case there are any charges incurred.

The Riad is NOT charging the credit card. The pre-authorization fund is held on the card by the issuing bank. A pre-authorization can be held for a minimum of 10 to 15 working days.

Pre-authorization should be released by the issuing bank automatically.

Cancellation policy

Standard Rate

A refundable deposit of 100 percent of the full stay including tax is required and will be charged at time of booking, excluding city tax. Reservations must be canceled by 12pm local time at least 14 days prior to arrival or 100 percent of the total stay will be charged. 

If the cancellation request is made between 14 days and 7 days prior arrival, 50% of the reservation amount will be due. 

Cancellation less than 7 days prior arrival can not be refunded and 100% of the full stay amount will be due. 

In case of early check-out or no show, the full stay amount will be due.

Non-refundable rates

This rate is non-refundable. Full payment will be required at the time of booking and in case of modification, cancellation or no-show, the whole amount is non-refundable.

Private Hire

A Deposit must be paid by wire transfer 50% in order to confirm the booking (Refundable until 30 days prior arrival). Cancellations after the 30 days prior arrival days will be fully charged.

Children policy

Rosemary does not accommodate minors (a person under the age of 14), unless the Riad is reserved privately, in its entirety.

Smoking policy

Please note that smoking is not permitted within the Road. Smoking is permitted only on the rooftop terrace. Smoking within the Riad will incur a charge of a full nights’ stay.

Any trademarks or logos used throughout this website are the property of Rosemary. Their use cannot be authorized without the prior written permission of their owner in accordance with copyright law. Any unauthorized use or reproduction in total or in part of this website, by any means whatsoever, without the prior written permission of Rosemary is strictly prohibited and would constitute a copyright infringement punishable by the Moroccan Intellectual Property Code.

Newsletter

Settlement of disputes

The contract and the general conditions of sale are governed by Moroccan law.

In the event of any dispute relating to these general terms and conditions or the execution of the contract, the Customer shall contact the Customer Service of the Hotel.

In the event of a dispute that is not resolved amicably within 30 days from the date of referral to Customer Service, the Tribunal de Grande Instance de Marrakech shall have sole jurisdiction.

It is specified that the documents forming the contractual commitments between the parties are, in descending order of priority, the reservation voucher or request (including the special conditions of the reserved fare) and the present general conditions. In the event of contradiction between the reservation voucher and the general terms and conditions, the provisions appearing on the reservation voucher will be the only ones applicable for the obligation in question.
